GENERAL TERMS AND CONDITIONS PRODUCT SALES

This page (together with the documents expressly referred to in it) contains in addition to the General Terms and Conditions  information about Suigeneris Company and the legal terms and conditions on which Suigeneris Company sells the Products.  Note: we expressly want to make clear that we won’t & can’t sell alcoholic products to anyone below the 18 years of age.  Please stop your actions immediately and move away from the Suigeneris website, if you are under 18.  

 

ARTICLE 1 – APPLICABILITY TERMS AND CONDITIONS OF SALE PRODUCTS

1.1. The Terms and Conditions of Sale Products apply to every offer made by Suigeneris Company and to every Agreement that is concluded between Suigeneris Company and the Consumer for the sale of Product(s) via de Site. 

1.2. Prior to the conclusion of an Agreement the Terms and Conditions of Sale Products will be made available to de Consumer electronically in such a way that the Consumer can store them on a durable data carrier. 

1.3. Prior to the conclusion of an Agreement the Consumer will be asked to agree to these Terms of Sale Products. If Consumer refuses to accept these Terms and conditions of Sale Products, the Consumer will not be able to order any Product(s) from the Site. Therefore, Suigeneris Company emphasizes that the Consumer should read these Terms of Sale carefully and understands them, before ordering any Product(s) from the Site. 

1.4. Our e-shop (www.houseofsuigeneris.com/shop) is not meant for Consumers under 18 years of age. They are not allowed to purchase  and consume alcoholic beverages. Therefore, we expressly let visitors confirm that they are 18 years or older prior to entering the website of Suigeneris (www.houseofsuigeneris.com).  With accepting these sales terms and conditions the Consumer explicitly confirms (again) to be at least 18 years of age. 

ARTICLE 2 – OFFER 

2.1. Suigeneris will state clearly in the offer if the offer is limited to a period of validity or if specific terms apply to the offer. 

2.2. An offer contains an accurate and clear description of the Product(s) being offered, so the Consumer can assess the offer properly. The images of the Product(s) on the Site are for illustrative purposes only. Although every effort has been made to display the Product(s) accurately, Suigeneris Company cannot guarantee that the Product(s) or packaging may not vary slightly from those images. 

 2.3. All Product(s) shown on the Site are subject to availability. You will be informed by email as soon as possible if the Product(s) you have ordered is/are not available and your order will not be processed. 

2.4. Obvious mistakes made in the offer do not bound Suigeneris Company. 

ARTICLE 3 – AGREEMENT 

3.1. Once the offer is accepted by the Consumer, Suigeneris  will confirm acceptance to the Consumer by sending the Consumer an e-mail that confirms that the Product(s) have been dispatched (‘’Dispatch Confirmation’’). The Agreement will be concluded once Suigeneris  sends the Consumer a Dispatch Confirmation. 

3.2. The Consumer may cancel his/her order at any time before the Consumer receives the Dispatch Confirmation. For cancellations, please contact Suigeneris’ telephone line as specified under contacts, send a message using the contact page or send an e-mail to sg@houseofsuigeneris.com

3.3. If Suigeneris is unable to supply the Consumer with (one of) the ordered Product(s), for example because the Product(s) are not in stock or no longer available or because of an obvious error on the Site, Suigeneris will inform the Consumer by e-mail and will not process the order. If the Consumer has already paid for the Product(s), Suigeneris will refund the full amount, including any applicable charges the Consumer paid for delivery of the Product(s) from Suigeneris  to the Delivery Address. 

ARTICLE 4 – PRICE OF PRODUCTS 

4.1. The prices of the Product(s) will be as quoted on the Site from time to time. Suigeneris takes all reasonable care to ensure that the prices of Product(s) are stated correct on the Site. If an error in the price of the Product(s) ordered by the Consumer is discovered, the Consumer will be contacted and will be given the option of continuing to purchase the Product(s) at the correct price or cancelling the order. 

4.2. Suigeneris may change prices for Product(s) from time to time, but changes will not affect any order which has been confirmed with a Dispatch Confirmation. 

4.3. The price of a Product as stated on the Site includes VAT (and if applicable) excise duty at the applicable current rate chargeable in The Netherlands. 

4.4. The price of an Experience as stated on the Site includes VAT and excludes administrative fees. 

4.5. The price of a Product does not include delivery charges. Delivery charges are listed on the invoice.

ARTICLE 5 – BUSINESS CUSTOMERS 

If the Consumer is purchasing goods on behalf of a business, the Consumer confirms that he/she has authority to bind the business on whose behalf the Consumer purchases Product(s) on the Site. Furthermore, The Consumer commits the business for which the purchases are made not to re-sell the Product(s). In case of doubt Suigeneris Company has the right to decline/cancel an order or to maximize the quantity of ordered Products. 

ARTICLE 6 – RIGHT OF WITHDRAWAL, REFUNDS & RETURNS

6.1. When purchasing Product(s), the Consumer has the right to dissolve the Agreement during a period of 14 days in which the Consumer may asses if the ordered Product(s) meet(s) his/her expectations. This withdrawal period commences on the day the Consumer receives his/her order. In case the Consumer ordered several Products which are not delivered at the same time, the withdrawal period commences on the day the Consumer receives the last delivery of his/her order. 

6.2. In case the Consumer wants to exercise his right to dissolve the Agreement the Consumer should inform Suigeneris unequivocally within the withdrawal period as stated in article 6.1. In case the Consumer informs Suigeneris  by e-mail, Suigeneris will endeavour to respond to the Consumers withdrawal request as soon as possible and in any event within 2 working days (48 hours) of receiving his/her email. The Consumer is not obliged to state his/her reasons for dissolution. 

6.3. The Consumer shall return the Product(s) as soon as reasonably practicable, but no later than 14 days after giving notice of withdrawal as stated in article 6.2, in the original state and packaging. During the withdrawal period the Consumer will handle the Product(s) with care and will only unpack the Product(s) as far as necessary to properly assess the Product(s). Unless the Product(s) are faulty or not (as) ordered the Consumer will bear the costs of returning the Product(s). Refunds occur with the same payment method as used for purchasing the Product(s). 

6.4. The Consumer will receive a full refund of the amount he/she paid for the Product(s) including any applicable charges paid for delivery of the Product from Suigeneris to the Delivery address. The refund will be processed as soon as possible and, in any case, within 14 days of the day on which the Consumer gave Suigeneris notice of withdrawal as described article 6.2. 

ARTICLE 7 – DELIVERY 

7.1. Suigeneris delivers tangible e-shop purchases in the restricted EU area: The Netherlands, Germany, Luxembourg & Belgium. For product purchases and Delivery to other countries, please contact us via telephone number +31(0)203922384 or e-mail us via sg@houseofsuigeneris.com. 

7.2. The estimated delivery date is stated in the Dispatch Confirmation. For The Netherlands Delivery can be expected within 2-3 working days. For Belgium, Luxemburg and Germany Delivery can be expected within 3-4 working days. Delivery to other countries upon request (see article 7.1).  Delivery will be completed when the delivery provider delivers the Product(s) to the Delivery Address in the Netherlands, Luxemburg, Belgium and Germany as provided by the Consumer in the order. 

7.3. Suigeneris’ courier services are executed via one of the respected, well-established  and registered internationally operating delivery providers (carriers). For delivery in certain cities like Amsterdam (NL), Suigeneris may use professional bicycle courier services from registered delivery providers.

7.4. The Delivery provider will ask for a signature of the Consumer or a designated other recipient. 

7.5. If delivery is (partially) delayed or cannot be fully implemented, the Consumer will be informed about this at the latest 30 days after the order was placed. In this case, the consumer has a right to dissolve the Agreement. Following partial dissolution Suigeneris will refund the total amount paid for the Product(s) which are not delivered, or in case of dissolution of the entire Agreement, Suigeneris will refund the total amount paid by the Consumer including delivery charges. 

7.6. If the Customer chooses the  ‘Local Pickup’ option during the checkout process instead of ‘Delivery’, the Customer is expected to collect their order at Suigeneris Distillery in Amsterdam  during office hours within 30 days. Address: Metaalbewerkerweg 21, 1032KW, Amsterdam, The Netherlands

7.7. The risk of damage and/or loss of products rests upon Suigeneris until the moment of delivery to the Delivery Address or Customer’s Local Pickup has been completed.
